These Terms of Service ("Terms") govern your use of evkii.com and related EVKII, Inc. websites, and the EVKII Dial Bot SMS program. By using the site or opting into Dial Bot texts, you agree to these Terms.

Agreement to these Terms

If you do not agree, do not use the site and do not opt in to SMS. Paid project work is also governed by the EVKII Services Agreement accepted at checkout.

Website use

You may browse public pages and submit inquiries for lawful purposes. You will not misuse the site, attempt unauthorized access, or submit unlawful, misleading, or infringing content.

Site content is provided for general information. We may update pages, including these Terms, and the posted version is the current Terms of Service.

EVKII Dial Bot SMS program

EVKII Dial Bot / Kelly (Heath’s assistant) sends short post-call follow-up texts after an approved voice call. The program number is +1 (760) 388-2589 (+17603882589).

Messages include scheduling or next-step recaps related to that call. Frequency varies; typically under 10 messages per week. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Consent is not a condition of purchase. You can use EVKII’s website and services without joining this SMS program.

How to opt in and opt out

Opt in by submitting the consent checkbox on https://evkii.com/sms-dial-bot-opt-in.html (unchecked by default) or by texting START or YES to +1 (760) 388-2589.

Reply STOP to cancel. After you opt out we will send a single confirmation and then stop program texts, except as required by law. Reply HELP or email info@evkii.com for help. You may also text START again to re-subscribe.

Privacy

Our Privacy Policy at https://evkii.com/privacy.html describes how we collect and use personal information, including mobile numbers used for Dial Bot. The Privacy Policy is part of these Terms.

Intellectual property

EVKII names, marks, and site content are owned by EVKII, Inc. or its licensors. You may not copy or reuse them except as allowed by law or a written agreement.

Disclaimers and limitation of liability

The site and SMS program are provided "as is." EVKII does not warrant uninterrupted or error-free operation. To the fullest extent allowed by law, EVKII’s total liability for claims arising from the site or Dial Bot SMS is limited to the fees you paid EVKII in the twelve months before the claim, or fifty U.S. dollars if you paid none.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Courts in San Diego County, California have exclusive jurisdiction, except that either party may seek injunctive relief where needed to protect intellectual property.
